MANILA, Philippines — The Supreme Court of the Philippines did not issue a temporary restraining order but directed executive agencies to submit comments within 72 hours on a motion filed by Sen. Ronald dela Rosa questioning the validity of an arrest warrant issued by the International Criminal Court.
The court required the Office of the Executive Secretary, Department of Justice, National Bureau of Investigation and Philippine National Police to respond within the period. It also gave dela Rosa 72 hours from receipt of the comments to file a reply.
Supreme Court spokesperson Camille Ting said the court’s resolution did not address the request to temporarily stop a possible arrest.
The court said it may take interim or urgent measures if circumstances require.
The ICC unsealed the arrest warrant against dela Rosa on May 11, naming him an alleged indirect co-perpetrator in crimes against humanity linked to the Duterte administration’s anti-drug campaign. The warrant was originally issued under seal on Nov. 6, 2025.
Dela Rosa’s legal team filed the motion after an attempted arrest by the NBI at the Senate earlier this week.
