Manila, Philippines — In a significant diplomatic initiative, Senator Francis Tolentino has championed the establishment of a comprehensive Code of Conduct (COC) for the South China Sea, aligning with the United Nations Convention on the Law of the Sea (UNCLOS) and the pivotal 2016 Arbitral Award. This proposal emerges as a strategic effort to manage escalating tensions among various claimant states and ensure adherence to international maritime laws.

The complex geopolitical landscape of the South China Sea, a crucial maritime corridor for global trade, has long been a point of contention, with overlapping territorial claims from multiple nations, including China and several Southeast Asian countries. Senator Tolentino’s advocacy for a UNCLOS-backed COC aims to address these disputes peacefully and foster a stable maritime order in the region.

The proposed COC seeks to integrate and uphold the principles established by UNCLOS, emphasizing the necessity for a legally binding framework that safeguards the rights and responsibilities of the claimant states. The 2016 Arbitral Award by the Permanent Court of Arbitration, which rejected China’s extensive territorial claims, underscores the legal basis for Tolentino’s proposal and reinforces the significance of aligning with established international norms.

Negotiations between the Association of Southeast Asian Nations (ASEAN) and China have been ongoing for years, focusing on formulating a regulatory structure that balances regional interests while maintaining peace and cooperation in the contested waters. Tolentino’s call for such a code highlights the essential role of international collaboration and dialogue in resolving maritime disputes and achieving lasting geopolitical stability.

ASEAN’s involvement in the discussions further reflects the organization’s commitment to regional peace and conflict resolution. A successfully implemented UNCLOS-aligned COC could serve as a global model for managing similar territorial disputes, thereby reinforcing international law’s role in sustainable maritime governance.

As the strategic importance of the South China Sea continues to attract international scrutiny, the need for a consensus that respects established maritime laws becomes increasingly paramount. Senator Tolentino’s initiative aligns with broader global efforts to bolster the adherence to international maritime law and maintain peace in contested marine areas.
