Lawmakers eye tighter AI rules, cite mental health concerns

Texas lawmakers on an interim committee are examining how people in the state use artificial intelligence for mental health support and how the state may need to regulate the technology to address public safety and health concerns.

Legislators are holding hearings at the Texas Capitol to gather information from experts, state agencies, technology companies and mental health professionals about the use of AI tools for emotional support and counseling-type conversations.

Committee members are reviewing access to AI chatbots and apps for mental health questions and how often people use those tools instead of licensed therapists or other qualified providers.

Lawmakers are asking witnesses to explain how AI systems respond when users report depression, anxiety, self-harm, suicidal thoughts or other mental health concerns.

Members of the committee are requesting data on the number of AI products that present themselves as mental health tools, wellness assistants or virtual companions in Texas.

Mental health professionals are telling lawmakers that more people are using AI chatbots and apps because these tools are accessible at all hours and respond quickly.

Officials are addressing whether AI systems could support mental health programs under professional supervision or within regulated healthcare settings.

Legislators are comparing Texas efforts with actions in other states and countries that have issued guidance or rules on AI use in healthcare and mental health.

The committee will submit a report that may include proposals on disclosure requirements, safety standards, data protections and oversight structures for AI tools that interact with Texans on mental health issues.
