Paxton: Transgender people cannot alter sex on IDs in Texas

Texas Attorney General Ken Paxton has issued an official opinion declaring it unlawful for transgender individuals to modify the sex designations on their driver’s licenses and birth certificates.

Paxton’s statement, released on Friday, challenges the validity of court orders that have allowed these changes, suggesting that any documents that have already been altered must be reverted to their original state.

In his opinion, Paxton argues that current Texas law does not authorize the alteration of sex designations on official documents through court orders.

This opinion comes amid growing legal recognition of transgender individuals’ rights to update their identification documents to reflect their gender identity.

The opinion has immediate implications for the transgender community in Texas, as it could affect both individuals seeking to modify their documents in the future and those who have already done so.

Many transgender individuals rely on accurate identification for essential life activities, including employment, healthcare, and legal identification, and the potential reversal of these changes raises concerns about the practical impact on their daily lives.
