ICE issues ultimatum to Democratic-led states over migrant detainment

WASHINGTON — The Department of Homeland Security (DHS) has warned California, New York, and Illinois of possible legal action if the states continue to refuse cooperation with federal immigration enforcement authorities, CBS News reported this week.

The warning marks an escalation in the ongoing conflict between the federal government and states identified as sanctuary jurisdictions—those with policies limiting collaboration between local law enforcement and federal immigration agencies.

DHS officials argue that the refusal to detain undocumented migrants at the request of Immigration and Customs Enforcement (ICE) undermines national security and public safety.

ICE routinely issues detainer requests asking local law enforcement agencies to hold individuals suspected of immigration violations until federal agents can take them into custody.

Sanctuary states often decline these requests, citing concerns over civil liberties, legal authority, and the need to maintain trust between immigrant communities and local police.

DHS officials said that non-compliance with federal immigration laws may result in lawsuits aimed at compelling cooperation. The agency maintains that states have a legal obligation to assist in federal immigration enforcement efforts.

California, a long-time sanctuary state, enforces its Sanctuary State Law, which restricts the sharing of information about immigration status and limits local agencies from participating in immigration-related activities.

State officials argue that such measures are intended to protect residents’ rights and improve public safety by encouraging community cooperation with law enforcement.

New York and Illinois have adopted similar approaches. Both states have enacted legislation that limits compliance with ICE detainer requests and restricts the disclosure of immigration-related information.
