Tilman Fertitta’s Landry’s, Inc. loses legal fight with Landry Distillery

Houston-based company Landry’s, Inc., founded in 1980 and owned by billionaire Tilman Fertitta, has lost a lawsuit against Landry Distillery over the use of the name “Landry.”

The court ruled in favor of the distillery, stating that there was insufficient evidence to prove the use of the name would cause customer confusion or harm Landry’s, Inc.’s brand.

The dispute arose when Landry’s, Inc. claimed that Landry Distillery’s use of the name infringed on its trademark.

The company, known for its restaurants, hotels, and casinos across the United States, argued that the distillery’s name could lead to confusion among customers, potentially damaging its reputation.

Landry Distillery, however, stated that its name reflected the founder’s family heritage and was not intended to associate with Fertitta’s company.

The Texas court examined the arguments and evidence from both sides, including branding strategies and market presence.

Despite Landry’s, Inc.’s long-standing presence in the market, the court ruled that the distillery’s use of the name did not pose a threat to the company’s brand identity.

Fertitta, who also owns the NBA’s Houston Rockets, has not commented publicly on the court’s decision.

Landry’s, Inc. manages well-known brands like Bubba Gump Shrimp Co. and Morton’s The Steakhouse. Fertitta’s business interests extend beyond hospitality to technology and sports.

Following the ruling, Landry Distillery expressed satisfaction, emphasizing its commitment to its family legacy and the unique identity of its products.
