Texas House approves THC ban; Governor Abbott set to decide

Texas Senate Bill 3, which seeks to ban the sale and possession of consumable hemp products containing tetrahydrocannabinol (THC), is now awaiting action from Governor Greg Abbott.

The bill, passed by both the Texas House (95-44) and Senate, targets products such as edibles, beverages, vapes, and synthetic cannabinoids like delta-8.

If signed into law, the ban would take effect on September 1, prohibiting consumable THC hemp products and explicitly banning items resembling children’s snacks and drinks to prevent marketing targeting minors.

Hemp industry leaders have urged Governor Abbott to veto the bill, warning of significant economic consequences including business closures and job losses in a multi-billion-dollar sector.

The bill’s passage will also require adjustments from law enforcement and the judicial system, as possession of banned THC products may result in legal penalties, including jail time.
