MANILA, Philippines — The Commission on Elections (Comelec) Second Division has dismissed a disqualification case filed against Senator-elect Erwin Tulfo in connection with the May 12 midterm elections.
In a 25-page ruling, the division rejected the petition filed by Toto Causing and Graft-Free Philippines Foundation Inc. (GFPFI), which questioned Tulfo’s eligibility to hold public office. The petitioners cited issues related to Tulfo’s citizenship as grounds for disqualification.
The Comelec ruled that the allegations concerning Tulfo’s citizenship should have been raised through a petition to cancel his certificate of candidacy, not through a disqualification case. The commission emphasized that the legal remedy used by the petitioners was improper for the nature of the claim presented.
With the dismissal of the case, Tulfo remains eligible to assume his position as senator following his victory in the recent elections.
