ICC finds Duterte capable of facing trial, victims call for speed

Pre-Trial Chamber I of the International Criminal Court on Friday received and released expert medical reports concluding that former Philippine president Rodrigo Duterte remains fit to participate in his upcoming war crimes proceedings, according to a filing from the Office of Public Counsel for Victims.

Court-appointed medical experts conducted the examination after the chamber ordered the assessment in September 2024, following a defense request in August 2024 for an indefinite adjournment due to health concerns.

The judges tasked the experts with determining whether Duterte faced any physical or mental condition that could prevent him from understanding the pre-trial process, including the confirmation of charges hearing in the case concerning alleged crimes against humanity in the Philippines.

Victims’ legal representative Paolina Massidda reported that the experts concluded Duterte met the court’s standards for fitness. The reports confirmed he could follow the proceedings and exercise procedural rights without limitations.

The Office of Public Counsel for Victims requested that the chamber schedule the confirmation of charges hearing immediately to ensure an expeditious trial for the victims.

Judge Iulia Antoanella Motoc, presiding over Pre-Trial Chamber I, will review the findings and establish the timeline for further proceedings.
