HOUSTON, Texas — The parents of a student from Milby High School who died in a train accident have filed a wrongful death lawsuit against Union Pacific.

According to legal documents, the lawsuit claims that both the rail company and the train’s operator were negligent. The family is seeking damages exceeding $1 million.

The incident occurred when Sergio Rodriguez, a 15-year-old student, was struck by a train on his way to school.

According to reports, the train was moving slowly at the time of the accident.  Rodriguez was reportedly crossing the tracks when the train hit him.

He was pronounced dead at the scene.

Houston Mayor Sylvester Turner has expressed the need for substantial safety measures, including potential infrastructure improvements near Milby High School. His office is in communication with local and state authorities to discuss necessary actions to address the community’s concerns.
