Duterte family seeks habeas petition after OSG recusal

MANILA, Philippines– The three children of former President Rodrigo Duterte have filed petitions with the Supreme Court in the Philippines to request a writ of habeas corpus for their father’s release from the International Criminal Court’s (ICC) custody.

Veronica Duterte cited the Office of the Solicitor General’s (OSG) recusal as proof of the illegality of her father’s detention and transfer to The Hague.

The Supreme Court has received the petitions filed by Veronica, Sebastian, and Paolo Duterte.

The petitions claim that the transfer of Rodrigo Duterte to ICC custody occurred unlawfully.

The habeas corpus petitions have been submitted to the Supreme Court to address the transfer and detention issues.

The Department of Justice (DOJ) has responded to the petitions, suggesting they are moot given Duterte’s current detention status with the ICC.

The Supreme Court’s decision remains pending on the habeas corpus petitions filed by Duterte’s children.
